These Terms of Service ("Terms") govern your access to and use of UnblockingAPI, a web unblocking and data retrieval API platform (collectively, the "Service"), operated by UnblockingAPI ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
You must be at least 18 years old to use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
To use the Service, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your password and API keys, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes, subject to these Terms and your subscription plan.
The Service is a general-purpose technical tool. You are solely responsible for how you use it and for the legality of your use. You agree that you will not, and will not permit anyone using your account or API keys to, use the Service to:
This list is illustrative and not exhaustive. We may, but are under no obligation to, monitor use of the Service, and we do not pre-screen, control, or endorse the targets, parameters, content, or purposes of your requests — these are determined entirely by you. You — and not UnblockingAPI — are solely and exclusively responsible and liable for your use of the Service and for any data you retrieve, store, process, or distribute through it. To the maximum extent permitted by law, UnblockingAPI disclaims any and all liability arising from any unlawful, malicious, abusive, infringing, fraudulent, or otherwise improper use of the Service by you or anyone acting through your account, and you assume full responsibility for all resulting consequences, claims, and damages. We may investigate suspected violations, suspend or terminate access without notice, and report and cooperate with law enforcement or affected third parties, in each case without liability to you.
Your use of the Service is subject to the usage limits and rate limits associated with your subscription tier. These limits include, but are not limited to, the number of API requests, bandwidth consumption, and requests per minute. We reserve the right to throttle, suspend, or restrict your access if we determine, in our sole discretion, that your usage constitutes abuse, exceeds fair use, or violates these Terms.
Fees are billed in advance on a monthly or annual basis, depending on your chosen subscription plan. All fees are exclusive of applicable taxes, which you are responsible for paying. You agree to provide accurate and up-to-date payment information. Non-payment or failure to resolve payment issues may result in the suspension or termination of your access to the Service.
Payments are processed through Stripe Managed Payments, under which Link acts as the Merchant of Record for your transaction. The Merchant of Record handles payment processing, invoicing, and the calculation and remittance of applicable sales tax and VAT on our behalf. By purchasing a subscription, you also agree to the applicable Stripe Consumer Terms of Service and Privacy Policy.
New subscribers may request a refund of their initial purchase only if both of the following conditions are met: (a) the request is made within 14 days of the date of the initial purchase, and (b) fewer than 500 API requests have been made on the account. If either condition is not met, the purchase is non-refundable. To request a refund, contact us at hello@unblockingapi.com within the 14-day period. Refunds will be processed within 5-10 business days to the original payment method. This guarantee applies only to the initial purchase; subsequent renewals are non-refundable.
The Service and all content, features, and functionality — including but not limited to software, code, APIs, documentation, design, and trademarks — are owned by UnblockingAPI or its licensors and are protected by intellectual property laws. You retain ownership of any data you submit to or retrieve through the Service, but you grant us a limited license to use, process, and store your data solely as necessary to provide the Service.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. The Service retrieves publicly available web content on your behalf. You are solely responsible for ensuring that your use of the retrieved data complies with all applicable laws and regulations, including data protection and intellectual property laws.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we make no warranty or representation that:
The Service retrieves content from third-party websites that are not owned, operated, or controlled by us. We are not responsible for and expressly disclaim any liability for:
You acknowledge and agree that you are solely responsible for evaluating and assuming all risks associated with the use of any content retrieved through the Service, and for ensuring that your use of such content complies with all applicable laws and the terms of the originating website.
You are solely responsible for:
We do not provide legal advice. The availability of the Service does not constitute an endorsement or guarantee that any particular use case is lawful in your jurisdiction.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF UNBLOCKINGAPI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Our total aggregate liability for any claims arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim. This limitation applies regardless of the theory of liability, whether based on contract, tort, negligence, strict liability, or otherwise.
You agree to indemnify, defend, and hold harmless UnblockingAPI and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
Either party may terminate these Terms at any time. We may suspend or terminate your access to the Service without prior notice if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination shall continue in full force and effect.
We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by email or through a prominent notice on the Service before the changes take effect. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of Malta. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Malta.
